Guidance: Contact Orders & Agreements

We understand that many people are currently missing spending time with their loved ones, particularly those parents whose time with their children has been impacted by the measures which have been put in place for the protection of everyone’s health. It is important in these difficult times that children are safe but also that family relationships are not compromised more than is necessary. We attach a copy of the guidance which has recently been issued by the Lord President (Scotland’s most senior judge) in relation to existing court orders, including contact orders. It clarifies that if parents live in separate homes but take turns to look after children that they can continue to do so in certain circumstances. Agreement between parents about what is best for their child is encouraged. If face to face contact cannot safely take place, a court will expect that alternative arrangements for contact are made via Face-Time, WhatsApp, Skype etc or, if video connection is not possible, by telephone.
